Nebraska Credit Services Organization Bond

A credit services organization conducting business in Nebraska must obtain a one-hundred-thousand-dollar surety bond or establish a one-hundred-thousand-dollar surety account under Neb. Rev. Stat. §45-805. The instrument runs in favor of the state and any person damaged by a Credit Services Organization Act violation. Credit services organizations offering credit-repair, credit-extension, or related credit services in Nebraska that must register with the Secretary of State under the Credit Services Organization Act.

How much is required

Section 45-805(1) fixes the bond or account at one hundred thousand dollars. A bond must be issued by a surety authorized in Nebraska. A surety account must be held at a federally insured Nebraska bank or savings and loan with notification of the depository, trustee, and account number filed with the Secretary of State.

How to get and file it

Have an authorized surety complete the Secretary of State’s Credit Services Organization Bond form for $100,000, or open a qualifying surety account and file the required depository notice. Submit the bond copy or account proof with the CSO registration and $100 initial fee. Maintain the bond or account until two years after the organization ceases Nebraska operations. Do not withdraw surety-account funds without the Secretary of State statement contemplated by §45-805(5).

No. Collection agencies use solicitor-count amounts under §45-608. Credit services organizations use a separate $100,000 bond or surety account under §45-805.

Can damaged consumers sue on the Nebraska CSO bond?

Yes. Section 45-805(4) allows a person claiming a Credit Services Organization Act violation to sue the organization and the surety or trustee, subject to the $100,000 limit.
