Missouri Credit Services Organization Bond

Missouri credit services organizations that charge or receive money before finishing the services they agreed to perform must keep a ten-thousand-dollar surety bond or surety account under § 407.639. A copy of the bond—or notice of the surety account—is filed with the director of finance.

Who requires it

Credit services organizations (and their salespeople, agents, or representatives) that take payment before completing all contracted services, as § 407.638(1) requires. Organizations that never take money early may not need this security, but registration and other Chapter 407 rules can still apply—confirm your model with the Division of Finance.

How much is required

Section 407.639(5) establishes a fixed ten-thousand-dollar bond or surety account. The instrument runs in favor of the state and of persons damaged by violations of §§ 407.635–407.644.

How to get and file it

Obtain a $10,000 surety from a company authorized in Missouri, or establish a surety account at a federally insured Missouri bank or savings and loan as the statute allows. File a bond copy—or the depository, trustee, and account-number notice—with the director of finance before taking advance payments. Maintain the bond or surety account until two years after the organization ceases operations. Claims cannot exceed the $10,000 amount.
