Anyone providing credit repair services to Louisiana consumers must maintain a $100,000 surety bond under R.S. 9:3573.4. The bond is filed with the Louisiana Attorney General—not the Office of Financial Institutions—even though OFI once regulated the activity. Who requires it

Credit repair services organizations as defined in R.S. 9:3573 et seq. that provide credit repair services to consumers in Louisiana. This is separate from collection-agency registration and from residential mortgage licensing.

How much is required

Section 9:3573.4(E) fixes the bond amount at one hundred thousand dollars. The statute also references trust-account mechanics in the section title; the operative amount published in subsection E is $100,000.

How to get and file it

Have a surety licensed in Louisiana issue a $100,000 credit repair services organization bond in favor of the state of Louisiana for the benefit of damaged persons, then file it with the Attorney General. If an older bond still names the Office of Financial Institutions, arrange an updated bond transferring the benefit to the Attorney General as OFI’s advisory directs. Keep the $100,000 bond on file with the Attorney General while offering credit repair services in Louisiana. Notify the Attorney General in writing within thirty days after ceasing to do business in the state. Failure to obtain or file the bond is itself a violation of the Part.

Frequently asked questions

Do I still need an OFI credit repair license?

No. OFI’s credit-repair page states that Act 858 moved jurisdiction to the Attorney General and ended licensure there. The $100,000 surety requirement continues under R.S. 9:3573.4.

Is this the same as a collection agency bond?

No. Collection agencies register with the Secretary of State and do not post a statewide surety under current registration law. Credit repair organizations post the Attorney General $100,000 bond under a different statute.
