Idaho Public Adjuster Bond

Before Idaho issues a public adjuster license—and while that license remains active—the applicant must keep twenty thousand dollars of financial responsibility on file with the Department of Insurance. Idaho Code § 41-5812 accepts either a surety bond from an insurer authorized in Idaho or an irrevocable letter of credit from a qualified financial institution. When that security ends or becomes impaired, the adjuster’s authority to act stops automatically until replacement proof is accepted.

Who requires it

Applicants for and holders of an Idaho public adjuster license under chapter 58, title 41, including resident and nonresident public adjusters.

How much is required

Section 41-5812 requires a minimum twenty-thousand-dollar surety bond in favor of the state—or an irrevocable letter of credit in the same minimum amount—authorizing recovery for persons damaged by the adjuster’s erroneous acts, failures to act, fraud convictions, or unfair-practice convictions. Termination requires at least thirty days’ prior written notice filed with the department and given to the licensee.

How to get and file it

Complete the Department of Insurance public-adjuster application path. Have an authorized surety execute the department’s Bond of Public Adjuster form for $20,000, or arrange a qualifying irrevocable letter of credit, and deliver proof before expecting the license to issue or continue. Maintain the $20,000 security for the entire license term. Replace coverage before any cancellation effective date; a lapse automatically terminates authority to act as a public adjuster.

Cost note

Twenty thousand dollars is the required bond amount, not the premium you pay. See bond amount vs premium. Bond amount vs premium →

Frequently asked questions

Can I use a letter of credit instead of a surety bond?

Yes. Section 41-5812 expressly allows an irrevocable letter of credit from a qualified financial institution in the same $20,000 minimum amount as an alternative to the surety bond.

What happens if my public adjuster bond is cancelled?

If financial responsibility terminates or becomes impaired, authority to act as a public adjuster automatically terminates under § 41-5812 until replacement security is in place.
